6. Limitation of Liability (Expanded Version)
To the fullest extent permitted by applicable Dutch and EU law, RADIOM (including the freelancer, subcontractors, and any affiliated service providers) shall not be held liable for any damages arising from the use of our website, services, deliverables, maps, analyses, reports, or any geospatial products produced as part of our work.
Without limiting the generality of the above, we are not liable for:
6.1 Indirect, Consequential, or Special Damages

-
Loss of profits, revenue, or business opportunities
-
Loss of data or GIS datasets
-
Business interruption
-
Loss of goodwill or reputation
-
Costs related to operational delays
-
Any economic or commercial losses
-
Any claims by third parties related to your use of the deliverables
These exclusions apply even if RADIOM has been advised of the possibility of such damages.
6.2 Losses Arising from Geospatial Inaccuracies
Geospatial data may contain errors, outdated information, positional inaccuracies, or generalization effects.
RADIOM is not responsible for any losses resulting from:
-
Inaccurate, incomplete, outdated, or imprecise spatial data
-
Incorrect coordinate systems, projections, or transformations
-
Errors in third-party base maps, satellite imagery, or public datasets

-
Limitations, errors, or bugs in GIS software or processing tools
Clients are responsible for verifying the fitness of GIS data for their specific application.
6.3 Decisions Made Solely Based on Maps or Analysis
All maps, models, and analyses are decision-support tools, not definitive or authoritative instruments.
RADIOM shall not be liable for any consequences arising from:
-
Business, operational, engineering, legal, or financial decisions made solely based on our deliverables

-
Using GIS outputs outside the scope or intended purpose of the project
Maps and spatial analyses should always be used in combination with expert judgement and field verification.
6.4 The Nature of GIS Data and Its Inherent Uncertainties
GIS and geospatial science inherently involve approximations, modelling, and interpretation.
Accordingly, RADIOM does not guarantee:
-
Survey-grade accuracy unless explicitly agreed in writing
-
Completeness or correctness of any dataset
-
That datasets reflect real-world conditions at all times
-
That analyses are free from statistical or modelling limitations
Spatial data accuracy is influenced by scale, resolution, temporal variation, environmental conditions, and third-party sources. All deliverables are provided “as-is” within these constraints.

-
Cloud platforms (e.g., Google Drive, OneDrive, Dropbox)

This cap applies regardless of the nature of the claim (contract, negligence, tort, or otherwise).
